Ethics professionals and 2010 elections

Memo to: Ethics officers, academics and other professionals

I have contacted many candidates who have announced that they are running for the United States Senate or the House of Representatives in the 2010 elections. See this link.

As indicated in the link, I am urging the candidates to make business ethics an issue in the elections by means of a contention that plaintiffs' lawyers, among other things, undermine business ethics and lawmakers need to correct that.

I solicit you to explore further the contention, discuss it with colleagues, form your own opinion on the same, and express your opinion for the benefit of the candidates.

I have previously tried to email you twice, which emails you can find here.

I am very pleased that the Center For Class Action Fairness has filed a brief on behalf of objector Darren McKinney, and I very much hope that you will reject the settlement and request of Putative Class Attorneys for fees and costs as requested by Mr. McKinney.

I regret to say that I have concluded that this is a closed legal system in which the judges and the lawyers are out of touch with economics, business ethics and genuine justice, that going outside of the legal system is needed to remedy the situation, and I am attempting to do so in connection with the 2010 elections, as indicated here.

Dear ______,

I think plaintiffs' lawyers are counterproductive to the nation's economic recovery. I further think they undermine business ethics. Also, in instances of wrongdoing, they traduce justice in effectuating transfers among non-wrongdoing parties without regard to principles of unjust enrichment.

The driver of the predations of plaintiffs' lawyers on society are their compensation structures.

State attorneys general are in a good position to understand these predations and have an obligation to protect society from the predation by informing their state executive and legislative branches about the same so those branches can try to take appropriate corrective action and by making advocacy in the courts that judges employ their authorities and discretions to lessen the predation.

I hope you will, for the benefit of the citizens, raise this an issue in the upcoming attorney general election in California.

For your information, I have expressed objection both within the litigation and outside the litigation. You may learn more of what I have done at this link .

Based on personal experience in this case and others (see, e.g.
Papadakis v. Northwestern Mutual Life ), I believe this is a closed legal system in which the judges and the lawyers are out of touch with economics, business ethics and genuine justice.

Because of my belief about the closed nature of the legal system, as exemplified by this case, I am availing of the upcoming 2010 elections to go outside the legal system even more, which you may learn about here in my blog. I hope to hold up the Expedia litigation as a case in point for my criticism.

I would be interested in learning more about your views on this subject matter.
